2017年5月4日下午，由市政协办公室、潮阳区政协、市广播电视台联合主办的“社区议事厅——创文在路上”活动在潮阳区海门镇东门社区举行。本所主任律师、市政协委员谢丰凯先生参与了本次议事厅活动。

        In May 4, 2017, "Community Discuss Forum: Creating Civilized City on the Road" event held in Dongmen Community, Haimen County of Chaoyang District.This democratic forum was held jointly by the municipal CPPCC (Chinese  People Political Consultative Conference) Office of Shantou, Chaoyang CPPCC and Shantou Television. Peter F. K. Xie, as the director of Fengyue Law Firm and a member of Shantou CPPCC, was invited to participate in the forum.

       谢丰凯委员认为，农村在创文过程出现的一些现象和问题，如果没有通过建章立制的方式来归纳、总结、规定、规范，并且严格执行的话，势必将成为一阵风，运动式的推行一段时间就又冷落下来。所以说，要巩固创文成果必须建立长效机制，要建立长效机制就要坚持依法治村、民主治村，把乡规民约制度化，建立长效机制来解决。让实体内容可行、程序过程合法的制度得到大家共同认可、共同遵守、共同执行，而不是通过耗费大量的人力物力来管人，更不能靠长官意志来管事。制度不只是管村民，也管干部，干部更应该自觉遵守全体村民通过的规章制度。只有干部自觉地遵守规章制度，村民才会予以仿效互动。这样的话，就可以通过“村务运作到哪、规章制度就配套到哪、全体村民包括干部就执行到哪”这种制度性安排来产生良性循环和上下互动作用。谢丰凯委员认为，只有坚持不懈运用法治思维、采用法治方式、在法律框架内解决问题，创文强管长效机制才能真正建立，创文强管活动才能持续不断地引向深入，并且健康发展，才能得到老百姓的真诚响应和真心拥护

        Lawyer Xie proposed that a rational, normalized and enforceable institution must be made and strictly executed as a result for creating civilization (Chuang Wen) in rural areas, otherwise conventional problems will recur after campaign-style movement. This means a persistent institution is essential for promising the result of rural Chuang Wen. And for building such a persistent institution, it requests the governors to rule the villages by law and democracy method, instead of ruling by man. Meanwhile, those lawful and practicable local rules should be institutionalized and strengthened to become the common "laws" in rural China*. No man, both the rural governors and villagers, shall be exempted from those law. For rural governors, they should be more aware of the important of rural institutions and proactively obey rural norms, acting as a leading model for other villages. In another words, the institutionalization of rural governance and an equal law enforcement system will foster a healthy interactive governance atmosphere for rural areas. Peter pointed out that only when legal methodology and rule of law principle become the mind and frame for resolving issues in people’s life, a long-acting mechanism of Chuang Wen Qiang Guan can be seen as finally set up, so that Chuang Wen Qiang Guan can develop into a deeper level, winning the true recognition for Shantou citizens.   

        * (Noticeably, rural areas in China are diverse and often far from each other, each rural areamight have difference realities and different local norms. That is to say, rural norms often have their own realm.)

       特别在如何建立创文强管长效机制问题上，谢丰凯委员认为，创文是一种道德的引领，通过它，目的就是将人们心中的真善美和正能量弘扬出来，将假丑恶和消极的东西遏制下去。但道德是人心中的法律，只要不能自律，人心是没有办法控制的。因此，需要有强制性的东西来约束大家的行为。农村要建立创文强管长效机制，关键点还在于依法治村、民主治村，让村务在阳光下运作。例如，目前汕头正在广大农村地区推行三资平台（农村资产处置平台），以镇为单位，把村里的大小工程都通过平台来招投标，有的还让律师进行一条龙见证服务。通过这种公开的制度性的设计及方式发包工程，让村民感觉到公平公正、心服口服。谢丰凯委员还在最后的发言中给镇村两级支招，建议镇、村两级政府，一是要通过法治程序不断地完善和制订规章制度，依法依规来治镇、治村；二是要始终维护规章制度的科学性和规范性，不能使之成为废纸一张；三是要严格依法办事，自觉遵守和执行规章制度，这是重中之重；四是要充分发挥村居法律顾问律师在制定规章制度、进行法制宣传、举办法律讲座、化解矛盾纠纷和参与经济活动中的作用。

        From another perspective, Peter Xie argued that Chuang Wen also contains a task to intentionally develop a healthy mainstream morality and constrain the unhealthyones. That is because morality is the law of every man, and it will be impossibleto control oneself if there is no positive morality within a person. Moreover, the foster of morality cannot be realized just by teaching or letters in black. Therefore, a full functioning institutional soceity will be needed to produce the basis of social morality. But how to make a institutional society? This will request the rule of law, the rule of democracy and publicize the governance, letting the governance under legal and democratic surveillance. A good example of such institutional practice is the Capital, Asset, Resource Management System (CARMS, “三资平台”), which request all developing projects that subject to common rural interests should have a transparent bidding process. Some places even invited lawyers as the third party to provide a neutral witness service. It is said that villagers welcomed such open bidding process as they sensed more fairness and justice. 

        Additionally, Lawyer Xie also provided four suggestions for how to createlong-acting mechanism of Chuang Wen to the participating county and villagegovernors.

        1.    Setting up and developing a fully functionallocal norms regime through lawful procedures, using such norms and laws to govern the rural areas;

        2.    Securing the scientificity, normativeness and effectiveness of local norms;

        3.  Setting up enforcement supervision system, insuring the obedience and enforcementof law and local norms,

        4.  utilizing the knowledge and skills of rural legal consultants more sufficiently, such ason formulating local norms, providing legal education, mediating disputes and facilitating rural business.

       正如谢丰凯律师所一直倡议的：创文强管对于汕头新时期的发展非常重要，然而创文之路，任重而道远，需要法治作为一项内核，才能最终巩固创文的成果，也才能使汕头的发展事业长久持续下去。

        In accordance with Lawyer Xie’s proposal, Chuang Wen movement must incorporates rule of law, which he found as a crucial requirement to secure the effort of Chuang Wen, into its outline, so that the outcome of Chuang Wen will stand for a chance to become a long-lasting development of Shantou.
